H. L. A. Hart’s The Concept of Law (Hart 1994) contains many passages that have become iconic for legal theory. This essay focuses on Chapter 7, sections 1 and 2, and Hart’s comments about judicial discretion in the context of Ronald Dworkin’s well-known attack on the idea of judicial discretion in his essay “The Model of Rules”. Specifically, the paper undertakes three projects. The first project is to defend the importance of the fundamental picture that Hart presents in Concept, Chapter (...) 7 of Common-Law judicial rule-making. Hart represents such rule-making as a balance of certainty and flexibility, and he is correct to do that. The second project is to argue that Dworkin’s attack on the positivist model of common-law judicial rule-making as an exercise of “strong discretion” fails. The idea, central to the meaning of “strong discretion” that courts are not “not bound by standards set by the authority in question” cannot be established. The third is to argue that Hart is his own worst enemy. The language, metaphors and images he uses to present his account of common-law judicial rule-making open the way to Dworkin’s critique. They also reveal Hart, if the language, metaphors and images are taken seriously, to be precisely the kind of formalist or deductivist about adjudication that he is ostensibly in Concept Chapter 7 criticising.Resumen:El concepto de derecho (1994) de H. L. A. Hart, contiene muchos pasajes que se han convertido en íconos de la teoría jurídica. Este artículo se concentra en el capítulo 7, sección 1 y 2, y en los comentarios que realizara Hart sobre la discreción judicial en el contexto de la bien conocida crítica de Dworkin a esta misma idea en su ensayo “El modelo de las normas”. Específicamente, el artículo emprende tres proyectos. El primero de ellos consiste en defender la importancia del esquema fundamental que ofrece Hart en el capítulo 7 de su obra, esto es, la creación judicial de normas en el Common Law. Hart representa tal creación de normas como un balance de certeza y flexibilidad; y él está en lo correcto al presentarlo de tal modo. El segundo proyecto consiste en argumentar que la crítica de Dworkin al modelo positivista de la creación judicial de normas en el Common Law, como un ejercicio de “discreción fuerte”, no está sustentada. La idea —central para el significado de “discreción fuerte”— de que los tribunales no están “sujetos a criterios establecidos por la autoridad en cuestión” no puede ser establecida. El tercer proyecto consiste en argumentar que Hart es su peor enemigo. El lenguaje, las metáforas e imágenes que emplea para exponer su teoría de la creación judicial de normas en el Common Law abre la puerta a la crítica dworkiniana. Humans are experts in cooperating with each other when trying to accomplish tasks they cannot achieve alone. Recent studies of joint action have shown that when performing tasks together people strongly rely on the neurocognitive mechanisms that they also use when performing actions individually, that is, they predict the consequences of their co‐actor’s behavior through internal action simulation. Context‐sensitive action monitoring and action selection processes, however, are relatively underrated but crucial ingredients of joint action. In the present paper, we try (...) to correct the somewhat simplified view on joint action by reviewing recent studies of joint action simulation, monitoring, and selection while emphasizing the intricate interrelationships between these processes. We complement our review by defining the contours of a neurologically plausible computational framework of joint action. (shrink)

The number of traumatic events that occur worldwide is increasing, yet the literature pays little attention to their implications for leader development. This paper calls for a consideration of how collective trauma such as genocides and the Holocaust can shape the cognition of leaders who are second- and third-generation descendants. Drawing on research on the transgenerational transmission of collective trauma, social learning, social identity and psychodynamic theories, we identify three mechanisms through which collective trauma can be transmitted to leaders: cultural (...) artifacts, community events and family narratives. In this article, we introduce the topic of collective trauma in leader development and draw on the theories of psychodynamic, social identity and social learning to explain how the transmission of collective trauma occurs. We also propose how the transmitted trauma shapes leader cognition, values and behaviors. This framework can serve as a basis for future theory-building in leader and leadership development that will be key to the study of authentic and ethical leadership. (shrink)

A generation of students at the Faculty of Theology of the K.U.Leuven have been introduced by Roger Burggraeve to the thoughts of Emmanuel Levinas. Levinas has been for him a true "master in thinking". For Levinas responsibility is heteronymous because it does not start from the "I" but from the epiphany of the other as the face, appealing to me not "to kill" but to promote him/her. In and through the appeal of the face, the difference between the other (...) and me - expressed in the irreducible alterity of the other - is, ethically speaking, the appeal to the highest "non-indifference": proximity without absorption. As Levinas' thinking carries on obvious Jewish-Talmudic imprint, Burggraeve was interested as to how the concept of responsibility can be connected to a biblically inspired ethic. In which way can the Levinasian view on responsibility enhance a Christian anthropology, and in particular that one articulated by Louvain personalism, and in its turn inspired by a Christian anthropology, so that it benefits from uniquely Christian accents? In this Festschrift for Roger Burggraeve, authors explore the theme of "Responsibility, God and Society" in order to answer two questions. What does Levinas' ethic of responsibility have to offer Christian theology? And vice-versa, what can Christian theology offer to contemporary ethical thought on personal, relational and societal responsibility. (shrink)

To study this interactive intelligence in the lab, we developed a new task that taps directly into the underlying abilities to communicate in the absence of a conventional code. The nm23 gene, a putative metastasis suppressor gene, was originally identified by its reduced expression in highly metastatic K‐1735 murine melanoma cell lines, as compared to related, low metastatic melanoma cell lines. Transfection of nm23 cDNA has been reported to suppress malignant progression in Drosophila and mammalian cells. Highly conserved homologues of nm23 have been found in organisms ranging from the prokaryote Myxococcus xanthus to Drosophila, where the gene is involved in normal development and differentiation. The product of the nm23 (...) gene exhibits a nucleoside diphosphate kinase activity, yet the nucleoside diphosphate kinase activity of Nm23 does not correlate with its apparent biological functions. We review recent cellular, genetic, biochemical and X‐ray crystallographic data to formulate and evaluate hypotheses concerning the molecular mechanism of nm23 action. (shrink)

Pentecostalism meant a break with Protestant anthropology hostage to the epistemology of Modernity. As Havey Cox explains, these American movements in the early years of the 20th century filled the ecstatic deficit left by evangelicals, pointing towards the affective system of knowledge of reality, an affective epistemology. If, on the one hand, the Pentecostal experience encouraged the shift from the margin to the center of corporeality, on the other, the violated and subjugated bodies became visible and empowered, because marginalized groups, (...) excluded by the American and Brazilian Protestant establishment, were and are protagonists. Pentecostal movements are presented as a presence in the world and religious practice that reveals the defense of fundamental rights, especially in the militancy experience of racial justice, which does not mean a theoretical defense, but community experiences of excluded bodies that gain pneumatic status. The essay discusses the relationship between religion, human rights and racial issues, pointing out how Pentecostalism represents intuitions for a more fraternal and egalitarian society. (shrink)

In 1893, The World’s Parliament of Religions met in Chicago from the 15th of May until the 28th of October. 2013 marked the 120th anniversary of this gathering where the leading representatives of the religions of the world engaged in dialogue. To commemorate this event, Special Collections Research Center at Southern Illinois University Carbondale in conjunction with the Hegeler Carus Foundation hosted a symposium on the relationship between science, religion, and philosophy. One of the themes of the Parliament was “…the (...) actual harmony of science and religion; and the origin and nature of the alleged conflict between them.” Featured speakers addressed these issues igniting fascinating conversations. O presente artigo tangencia o conceito de tensor esgueirando-se pelos platôs linguísticos de Mil platôs, agenciando o que Deleuze e Guattari potencializam em o que passou?, e que buscamos atualizar em o que passa? Nesse sentido, buscamos a articulação entre o que ambos os conceitos movimentam: isso, que acontece na relação entre dois ou mais estratos. Percebemos que o tensor transversa a obra de Deleuze e Guattari e, mesmo que não exerça um relevo, está lá, estrategicamente em funcionamento. Destarte, desejamos (...) articular com esses conceitos de partida, uma possibilidade para poder inventariar os deslocamentos imanentes de escrileitura, como forma de aproximar procedimentos didático-tradutórios, que possam vir a ser envolvidos em uma pesquisa, que deseja experimentarse em momentos de invenção. Para tanto, problematizamos uma tríade conceitual – tensor, o que passa?, e escrileitura, de modo a possibilitar perspectivas de composição e de funcionamentode uma máquina abstrata escrileitora de invenções. Com o Método Maquinatório de Pesquisa, afirmamos a busca por dar vez e voz a um processo de maquinações, que possam vir tensionar uma crítica sintomatológica, duplamente articulada a uma clínica maquinatória; um Plano de Organização tensionado por um Plano de Invenção; e, no intermezzo desses encontros, algo passa, algo pode passar; e, assim, persistem os rastros de uma escrileitura, envolta e revolta em um contínuo recursivo: escrever-ler-escrever. Cela n'a rien d'intellectuellement honteux, contrairement à ce que disent certains philosophes, en parlant d'une éthique des croyances Une nouvelle question se pose alors : a-t-on le droit de croire avoir reçu une révélation et prétendre connaître ainsi la vérité? Non, répondent ceux pour lesquels la vérité ne peut pas (...) être donnée par Dieu dans la Bible. Oui, affirme ce livre, et, qui plus est, une épistémologie peut défendre la rationalité de notre croyance à la révélation. Dès lors, peut-on faire comme si les affirmations du Credo étaient des fictions? Est-il vrai que la religion est avant tout une affaire pratique et une forme de vie? In her book Michel de Montaigne: Accidental Philosopher, Ann Hartle argues that Montaigne’s thought is dialectical in the Hegelian sense. Unlike Hegel’s progressive dialectic, however, Montaigne’s thought is, according to Hartle, circular in that the reconciliation of opposed terms comes not in the form of a newly emergent term, but in a return to the first term, where the meaning of the first is transformed as a result of its dialectical interaction with the second. This analysis motivates Hartle’s claim that (...) Montaigne is not a skeptic at all, let alone a Pyrrhonian skeptic. In this paper, I argue that Hartle’s circular-dialectical interpretation of Montaigne is not only compatible with Pyrrhonism, but is in fact an ideal model for understanding Sextus Empiricus’s skeptical therapy. Thompson Clarke’s seminal paper “The Legacy of Skepticism” (1972) is notoriously difficult in both substance and presentation. Despite the paper’s importance to skepticism studies in the nearly half-century since its publication, no attempt has been made in the secondary literature to provide an account, based on a close reading of the text, of just what Clarke’s argument is. Furthermore, much of the existing literature betrays (or so it seems to me) fundamental misunderstandings of Clarke’s thought. What is meant by innocence, passion, love and arousal, desire, perversion and shame? These are just a few of the questions Roger Scruton addresses in this thought-provoking intellectual adventure. Beginning from purely (...) philosophical premises, and ranging over human life, art and institutions, he surveys the entire field of sexuality; equally dissatisfied with puritanism and permissiveness, he argues for a radical break with recent theories. Upholding traditional morality - though in terms that may shock many of its practitioners - his argument gravitates to that which is candid, serene and consoling in the experience of sexual love. En 1869, le jeune Brentano (1838-1917) consacre une étude à Auguste Comte (1798-1857), dans laquelle il rend un vibrant hommage au fondateur du positivisme. La question de la métaphysique mise à part, l’étude fait apparaître des affinités profondes entre le positivisme comtien et la philosophie de Franz Brentano : chez les deux penseurs on rencontre en fait le même refus de séparer la philosophie de la science. Au-delà de ces affinités qui existent au départ, la lecture de Comte aura durablement (...) marqué la pensée de Brentano. Tout ceci explique pourquoi l’héritage de Brentano a pu jouer un rôle certain dans l’avènement du néo-positivisme dans la Vienne des premières décennies du XX e siècle. La position particulière que Brentano occupe aussi bien par rapport au positivisme ancien qu’au néo-positivisme soulève deux problèmes majeurs. Le premier a trait au rôle que Brentano a pu jouer dans la transmission de l’idéal positiviste. Le second, plus fondamental, se rapporte aux liens généralement sous-estimés qui existent entre le néo-positivisme et la philosophie positiviste de Comte. (shrink)

En 1910, Jan Lukasiewicz publiait Du principe de contradiction chez Aristote. Dans cet article, on explique les points principaux du livre de Lukasiewicz. Ce dernier affirme qu’Aristote n’a pas réussi dans sa tentative pour justifier le principe de contradiction. En fait, ce principe est moins logique qu’éthique, selon Lukasiewicz, et cela explique bien des difficultés posées par la théorie d’Aristote. On discute également de la façon dont Lukasiewicz utilise la notion d’« objets contradictoires », empruntée à la Théorie des Objets (...) de Meinong ; on montre que Lukasiewicz se situe dans le cadre d’une version brentanienne de l’aristotélisme. Certaines connexions entre Lukasiewicz et la conception wittgensteinienne de la nécessité ou le conservatisme logique de Quine sont indiquées. Le but de mon article est essentiellement d’encourager une lecture attentive du livre qui n’a pas reçu l’attention qu’il mérite parce qu’il a été écrit à l’origine en polonais. Souvent, les philosophes croient connaître son contenu à travers le résumé que Lukasiewicz écrivit en allemand en 1910, et qui a été traduit en anglais. Mais, en fait, il y a bien des choses importantes dans le livre qui n’apparaissent nullement dans le résumé.In 1910, Jan Lukasiewicz published On the Principle of Contradiction in Aristotle. In the present paper, I explain the main points in Lukasiewicz's book. Lukasiewicz claims that Aristotle was not successful in his attempt to justify the principle of contradiction. In fact, this principle is less logical than ethical, according to Lukasiewicz ; and this accounts for many of Aristotle's difficulties. Lukasiewicz's use of the notion of “contradictory objects”, taken from Meinong's Theory of Objects , is also discussed, and Lukasiewicz is shown to be situated within the Brentanian form of Aristotelism. I also indicate some connections between Lukasiewicz and Wittgenstein on necessity, and between Lukasiewicz and Quine on logical conservatism. The goal of the present paper is principally to encourage an attentive reading of a book that has not received the consideration it deserves because it was initially written in Polish. Often, philosophers believe that they grasp the content of the book through the brief abstract which Lukasiewicz wrote in German in 1910, and which has been translated into English ; but in fact there is much of importance which the abstract does not cover. Marriagelike homosexual relationships expose a division among ethicists following Aquinas. Those emphasizing natural law may call such relationships unnatural; those emphasizing the virtues may approve of relationships fostering love and justice. Natural law, the virtues, and homosexuality all show up in Aquinas's "Commentary on Romans"--untranslated and hardly cited. Romans 1:18 opens a discussion of justice. Verse 20 provides Aquinas's chief warrant for natural law. Verse 26 applies virtue and law to "the vice against nature." But Aquinas's account also depends on (...) Paul as an exemplar of virtue and on Aquinas's high regard for the Bible. Aquinas deploys natural law as a mode of biblical exegesis, not an alternative to it. In the "De potentia", Aquinas considers how to proceed when nature and Scripture seem to conflict. The account does not settle, but rather makes more room for, dispute. (shrink)
